Rules and By-Laws

The GeorgeTown (South) Local Association of Scouts
1. | NAME: The Association shall be called the GeorgeTown (South) Local Association of Scouts (refer as the Local Association hereinafter). | |
2. | FUNCTIONS: The functions of the Local Association shall be: | |
a. | To safeguard and encourage the Movement within its area with the least possible interference with the independence and initiative of the registered Scout Groups; | |
b. | To deal, as laid down, with all matters allotted to it under Policy, Organisation and Rules of the Scouts Association of Malaysia, and in particular with Warrants, under Part III, Non-Warranted, and Honorary ranks under Rules 155 to 156, the B-P Scout Guild under Appendix C, Group registration under Rules 177 to 196, Membership of Wolf Cubs, Boy Scouts, Senior Scouts, and Rover Scouts, under Rules 197 to 200 and Decoration and Awards under Part X. | |
c. | To supervise Group Finance, the appointment of Group Committees in accordance with Rules 202 to 203, and the establishment of proper Trusts of Group Property in accordance with Rules 204 to 206. | |
d. | To be responsible for the grant of all badges and to arrange examinations for Proficiency Badges in accordance with the Rules for these badges in Section XII. | |
e. | The Local Association shall also raise and administer funds for its working expenses, and for helping in suitable ways the Group within its area, provided that all methods of raising funds are in accordance with Rules 17 to 21, and that funds and property are administered in accordance with Rules 148 to 150. | |
f. | The Local Association shall give full support and assistance to the District Commissioner in his functions as laid down in Rules 124 to 126, and shall accept him as the appointed authority in accordance with P.O.R. for the training, administration, conduct and progress of the Movement in the District. In the event of any dispute arising between the District Commissioner and the Local Association, the Local Association shall follow the procedure laid down in P.O.R. and refer the dispute to the State Commissioner for decision. | |
3. | POLICY: Its decision shall always be in accordance with the existing Policy, Organisation and Rules for Scouts Association of Malaysia. | |
4. | MEMBERS: | |
a. | Elected – Elected members shall be members of the public, former Scouts, parents of Scouts, and other, who pay an annual subscription of MYR3 to the Local Association, and whose application for membership is approved by the Executive Committee provided that an application may be refused without any reason being given to the applicant. | |
b. | Life Membership – Will be opened to all those (under A) who pay MYR50 to the Local Association. | |
c. | Ex Officio – All Warranted Scouters (except Assistants) of Groups registered in the District covered by the Local Association, together with District Commissioner, and all Assistant District Commissioner shall ex officio be members of the Local Association. | |
d. | Voting Rights – Only duly elected members who have paid their annual subscription for the current year, life members, and ex officio members may vote at meetings of the Local Association, or be elected for any office in the Local Association, in accordance with these By-Laws. | |
5. | EXECUTIVE COMMITTEE – The Executive Committee of the Local Association shall consist of the Chairman, Vice Chairman, Secretary, Assistant Secretary, Treasurer, Assistant Treasurer. Four lay members and five Group Scouters, all of whom shall be elected at the Annual General Meeting. Ex officio members are District Commissioner and Assistant District Commissioner. In the event of an elected member of the Committee being unable to continue in office, the Executive Committee may co-opt a member of the Local Association to take his place. The Executive Committee shall be responsible for the administration of the Association monies. The financial policy shall at all times be governed by rules made from time to time by the Finance Committee of the Penang State Scout Council. The Committee shall meet at least four times a year, and six members shall form a quorum.
The Executive Committee shall consist of six members to form a quorum of twelve members. BADGE SUB COMMITTEE: This shall be appointed by the Executive Committee, and shall consist of the Local Association Chairman, District Commissioner, a Badge Secretary (who shall not be a Scouter), and three members, at least one of whom must be a Group Scouter, all of whom shall be of the Local Association. |

6. | ELECTIONS: Candidates of the offices of Chairman, Secretary, Treasurer, and lay, and Scouter members of the Executive Committee shall be proposed and seconded at the Annual General Meeting. There shall be a ballot if more than one candidate is proposed and seconded for a particular office.
The Annual General Meeting shall elect two lay members and one Group Scouter as representatives to the Penang State Scout Council (of which the District Commissioner, the Chairman, the Honorary Secretary of the Local Association are ex officio members). The names and addresses of all members elected under the Rules shall be sent to the Honorary Secretary of the Penang State Scout Council, and Scouts Association of Malaysia within one week after the Annual General Meeting. |

7. | ANNUAL GENERAL MEETINGS: The Annual General Meeting of the Local Association shall be held after January 1 and before March 31, in each year. Fourteen days’ notice in writing shall be given to all members of the meeting. Notice shall be given to the Honorary Secretary in writing not less than three days before the meeting of any motion to be proposed by any member. Fifteen members shall form a quorum. | |
8. | EXTRAORDINARY GENERAL MEETING: An Extraordinary General Meeting of the Local Association shall be called: | |
a. | on the direction of the State Commissioner; | |
b. | on the direction of the District Commissioner; | |
c. | on the application in writing to the Honorary Secretary of not less than ten members. | |
Seven days’ notice in writing shall be given to each member of any such meeting, and the purpose for which it is called. | ||
9. | ANNUAL REPORT: The Honorary Secretary shall present at the Annual General Meeting a written report on the activities of the Local Association during the preceding year. This report shall be the report of the Executive Committee. | |
10. | STATEMENT OF ACCOUNTS: The Honorary Treasurer shall present at the Annual General Meeting the accounts of the Local Association for the preceding year, duly audited by the independent Auditors appointed under Rule 11. | |
11. | AUDITORS: The Annual General Meeting shall appoint two independent Auditors for the ensuring year. | |
12. | ACCOUNTS: The accounts of the Local Association shall be closed on December 31 of each year, and copies of the audited accounts sent to the Honorary Treasurer of the Penang State Scout Council before March 31. | |
13. | REPORTS: The report and accounts of the Local Association shall be presented at the Annual General Meeting of the Penang State Scout Council. | |
14. | STATE COMMISSIONER: The State Commissioner shall be notified of all meetings of the Local Association, and he shall have the right to be present, and vote at any such meetings. | |
15. | ALTERATIONS AND AMENDMENTS: There shall be no effective alterations or amendments to the above Rules without the approval in writing of the Chief Commissioner for Malaysia. |
